S.C. & Associates Chiropractic Pty Ltd (ABN 91 612 587 854), trading as High Performance Chiropractic (“HPC”, “we”, “us” or “our”), is committed to protecting personal and health information. This policy explains how we handle information in connection with our clinic, website, advertising, enquiries and bookings.
We handle personal information under the Privacy Act 1988 (Cth) and the Australian Privacy Principles. As a private health service provider in New South Wales, we also handle health information under the Health Records and Information Privacy Act 2002 (NSW) and its Health Privacy Principles.
Information we collect
Depending on how you interact with us, we may collect:
- identity and contact details, including your name, date of birth, address, email address and telephone number;
- booking, appointment, billing, payment and transaction information;
- health information you provide in an enquiry, form, booking or consultation, including symptoms, medical history, treatment information, referrals and other clinical records;
- communications and feedback you send to us;
- information supplied by a parent, guardian, referring practitioner, insurer or another person where authorised or permitted by law; and
- technical and usage information, such as IP address, browser and device information, pages viewed, referring links and advertising or analytics identifiers.
How we collect information
We collect information directly from you when you contact us, complete a form, respond to an advertisement, book an appointment, attend the clinic or communicate with our team. We may also collect information through our website, booking and practice-management providers, advertising platforms, analytics tools and other service providers. Where lawful and necessary, we may receive information from a parent or guardian, another health practitioner, Medicare, an insurer or another authorised third party.
Our online booking service is provided through PracSuite. Information entered into an embedded or linked PracSuite booking form is also handled under PracSuite’s privacy terms. A short collection notice should appear at each form where we collect personal or health information.
Why we collect, use and disclose information
We collect, use and disclose information where reasonably necessary to:
- respond to enquiries and arrange, confirm or manage appointments;
- assess and provide chiropractic and related health services;
- maintain clinical, billing and administrative records;
- process payments, Medicare, insurer or other authorised claims;
- communicate about care, appointments and clinic administration;
- operate, secure, improve and measure our website and services;
- comply with professional, legal, insurance, safety and reporting obligations; and
- send marketing only where permitted and where any consent required for personal or health information has been obtained.
If we cannot collect information that is necessary for a booking or clinical service, we may be unable to respond fully, make the booking or provide the service safely.
Sensitive and health information
Health information is sensitive information. We generally collect it with your consent and only where it is reasonably necessary for providing or administering health services, or where another legal basis applies. We do not use health information for direct marketing without consent.
Advertising, analytics and cookies
Our website may use cookies, Google services, Meta technologies and similar tools to operate the site, measure traffic, understand advertising performance and prevent misuse. These tools may collect device, browser, IP address, page-view, referral and advertising-event information. We should not send clinical details, form-field contents or other health information to advertising platforms.
You can limit cookies through your browser and, where offered, our cookie controls. Blocking some cookies may affect website functionality. Advertising choices are also available through Google and Meta account settings.
Direct marketing
We may send service-related messages about appointments without treating them as marketing. We send promotional email or SMS only where permitted. Marketing messages will identify HPC and provide a functional way to unsubscribe. You may withdraw marketing consent at any time by using the unsubscribe facility or contacting us. We will action electronic-message unsubscribe requests within the period required by law.
Who we disclose information to
Where necessary and permitted, we may disclose information to practitioners and staff involved in your care; parents, guardians or authorised representatives; referring or treating practitioners; Medicare, insurers and claims administrators; professional advisers; regulators and authorities; and contracted providers supporting bookings, practice management, payments, communications, hosting, security, forms, analytics and advertising.
Some technology providers may process or store personal information outside Australia, including in the United States or other locations used by their service networks. Before production publication, HPC should confirm its current providers and the countries in which they process information.
Storage, security and retention
We use reasonable physical, technical and organisational safeguards appropriate to the sensitivity of the information. No internet transmission or storage system is completely secure. We retain records for as long as required for clinical, legal, professional, insurance and business purposes, then securely delete or de-identify them where lawful and practicable.
If a data breach is likely to cause serious harm, we will assess and respond to it in accordance with the Notifiable Data Breaches scheme and any other applicable requirements.
Access and correction
You may request access to, or correction of, personal or health information we hold about you. We may need to verify your identity. Legal exceptions may apply, and we will explain any refusal where required. Contact the Privacy Officer using the details below.
Anonymity and children
You may enquire anonymously or using a pseudonym where lawful and practicable. We normally need accurate identifying and health information to make a booking and provide safe clinical care. For children and young people, we may deal with a parent, guardian or authorised representative as appropriate, while respecting the young person’s privacy and capacity.
Privacy complaints
Please first contact our Privacy Officer with details of your concern. We aim to acknowledge and respond within a reasonable period, ordinarily within 30 days. If you are not satisfied, you may contact the Office of the Australian Information Commissioner or, for NSW health-information matters, the NSW Information and Privacy Commission.
